Strong Representation in the Evesham Township Municipal Court

Yesterday our firm represented two clients in the Marlton Municipal Court. the results obtained for both of the firm’s clients are great examples of why you should never just plead guilty. Our first client was charged with driving while intoxicated. This representation posed a  challenge for our Municipal Court criminal defense team because the client had four separate arrests for driving while intoxicated.  The penalties for a DWI conviction in New Jersey are severe.  Anyone who is convicted of a third or subsequent offense for driving while intoxicated faces a mandatory 180 days in jail.  We mounted a strong defense and carefully reviewed the state’s discovery.   After numerous appearances in court our client eventually plead guilty but did not go to jail. Our firm was able to meet our client’s objectives by keeping him out of jail.  As part of the sentence the judge suspended his jail term. While at the Evesham Municipal Court we were able to help another client who was charged with NJSA 39: 4- 85  – Passing to left when overtaking; passing when in lines; signalling to pass; passing upon right.  This offenses is commonly  referred to as  improper passing on right or off roadway.  A conviction on this charge would result in 4 MVC points in New Jersey.  You can review the NJ MVC point schedule by clicking here.  After a review of the state’s case against our client and extensive negotiation with the municipal prosecutor our client was able to plead to a reduced charge that had no points.
